Land Acquisition – Market Value Determination – Comparable Sale Method – The Court held that while determining the market value of the acquired land, it is essential to examine its geographical location, existing and potential use, and proximity to major roads or developed areas. The market value can be assessed using the comparable sale method by referring to contemporaneous transactions. The Court emphasized maintaining a balance between the interest of the parties and public interest, avoiding the distribution of public money as largesse [Paras 4.6, 4.7]​​ .

Compensation – Reasonableness – Assessment Criteria – The Court found no reason to interfere with the Reference Court's assessment, which increased the market value from Rs. 16,00,000/- to Rs. 17,00,000/- per acre. The Reference Court considered the sale of adjacent lands and improvements made by the acquiring body. The decision emphasized that compensation must be just and appropriate, considering all relevant factors without unduly favoring either the landowners or the government [Paras 4.10, 4.11]​​ .

Decision – Appeal Dismissed – The High Court dismissed the appeal, upholding the enhanced compensation assessed by the Reference Court. It was directed that the compensation already paid to the landowners should be considered final, with no further enhancements or reductions [Paras 4.8, 4.11]​​ .

Motor Vehicles Act – Compensation – Valid Permit – The High Court held that if a vehicle did not have a valid permit at the time of the accident, which was a violation of the insurance policy terms, the insurer could repudiate liability to reimburse the assured or victim. However, the insurer must initially pay compensation to the victim or his heirs and then recover the amount from the vehicle's owner/driver. The Court modified the MACT order accordingly, stressing that the insurance company cannot be absolved of its initial obligation to pay compensation [Paras 1, 17] .

Civil Procedure – Assessment of Compensation – The Court found fault with the MACT's assessment of the deceased's income at Rs. 8,000 per month and not accounting for future prospects. The Tribunal also erred by deducting 1/4th instead of 1/5th for personal expenses. The High Court revised the compensation by including 40% for future prospects and adjusting for the correct deduction rate, resulting in a total compensation of Rs. 21,05,320 [Paras 7, 12, 18] .

Decision – Appeal Allowed – The High Court allowed the appeal, modifying the MACT's award to Rs. 21,05,320. The insurance company was directed to pay the enhanced compensation with interest to the claimants, with the right to recover the amount from the truck owner and driver [Para 19] .

Civil Procedure – Will – Suspicious Circumstances – The Court held that it is not appropriate to permit a party to challenge the devolution of property by natural succession when a Will has been duly proved and established, merely based on suspicious circumstances, without proper pleadings and evidence. The party wishing to assail the correctness of the registered Will must lay a foundation in the pleadings and lead material evidence to prove such assertions. The other party, who has propounded the Will, cannot be taken by surprise at a later stage [Paras 1-14, 22] .

Gift – Acceptance – Modes of Proof – The Court observed that various modes exist to prove the acceptance of a gift, including the signatures/thumb impressions of the donee. It is not necessary to prove the delivery of actual physical possession of the property to complete the acceptance of a gift [Para 24] .

Decision – Appeal Allowed – The Court allowed the appeal, setting aside the judgment and decree of the First Appellate Court and restoring the judgment and decree passed by the trial court. It was held that the findings of the First Appellate Court regarding the suspicious circumstances surrounding the Will and the gift deeds were not sustainable.
