Therefore, the appellant is entitled to the benefit of reasonable doubt. However, the conviction and sentence awarded to accused No. 1 (who allegedly committed the murder) remain valid.

M/s. Eicher Tractors Ltd. imported bearings for tractors and tractor engines from M/s. NTN Corporation, Japan, from 1955.

In 1988, they switched to using bearings manufactured in India by M/s. HMT Ltd.

The Japanese vendor had a stock of 1989 bearings left, which they offered to sell to Eicher Tractors Ltd. at a competitive price in 1993.

The Assistant Commissioner of Customs challenged the declared value of these bearings, initiating a customs valuation dispute.

Subsequently, the Cancona Municipal Council granted a license for hotel construction on a plot of land in Nagorcem, Palolem, Taluka-Cancona, Goa.

The Goa Foundation, an environmental preservation organization, filed a writ petition before the Bombay High Court challenging the hotel's construction. Their grounds included:

The land in question was within CRZ-1, where construction was prohibited.

The permissions granted violated the Environment Protection Act, 1986, and lacked due consideration of relevant materials.

Existing structures and settlements were noted. The Central Government had carefully considered and approved the hotel project after a site inspection.

The Ministry of Environment and Forest, Goa authorities, and independent scientists had examined the hotel project thoroughly, including on-site visits. Environmental objections were duly considered before granting clearance. No infirmity in the clearance or overlooking relevant materials was found.

The subsequent report from the National Institute of Oceanography, obtained by the appellant, could not be considered to challenge clearance, especially when the project was nearing completion.

The Court emphasized the importance of balancing environmental protection and development, acknowledging the need to protect coastal zones while allowing for reasonable development.
