The High Court of Bombay dismissed the appellant's appeal, stating no substantial question of law arose for consideration.

The Supreme Court considered whether the Tribunal had the power to dismiss the appeal for want of prosecution. Section 35C(1) of the Central Excise Act mandates that the Tribunal must pass orders on the merits of the case and does not allow for dismissal due to non-appearance.
