In a significant decision, the High Court of Punjab and Haryana granted bail to Gurmeet Singh, who was incarcerated in connection with charges of corruption and other serious offences. The court observed that there would be "no justifiability for further pre-trial incarceration at this stage," subject to compliance with the terms and conditions laid out in the order.
Justice Anoop Chitkara, while delivering the judgment on 13th October 2023, emphasized the need to balance the liberty of the accused with the necessity of a fair trial. The petitioner, Gurmeet Singh, sought bail under Section 439 CrPC, contending that further pre-trial incarceration would cause irreversible injustice to him and his family.
The court meticulously laid down several conditions for the grant of bail, including the furnishing of a personal bond of Rs. 10,000, providing a surety of Rs. 25,000, and ensuring not to influence witnesses or tamper with evidence. Significantly, the petitioner was directed to use only one prepaid mobile phone number till the conclusion of the trial.
In its reasoning, the court referred to precedents such as Sanjay Chandra v. Central Bureau of Investigation and Sushila Aggarwal v. State (NCT of Delhi), underscoring that the bail conditions must be proportional to the purpose they seek to serve. "The courts while imposing bail conditions must balance the liberty of the accused and the necessity of a fair trial," the judgment read.
The decision has been welcomed by the petitioner's counsel, who highlighted the court's emphasis on ensuring justice while safeguarding the rights and liberties of the accused.
