A Land Acquisition Collector passed an award after the expiry of two years from the date of the publication of the declaration u/s 6 of the Land Acquisition Act, 1894.

The notification u/s 4(1) was published on 27.2.1991, challenged in writ petition No. 9715 of 1991, with an order staying dispossession on 16.7.1991.

Despite the writ petition, the government published the declaration u/s 6 on 10.4.1992.

The award, however, was passed only on 16.9.1994, clearly after the two-year period.

The appellant argued that since there was no stay for passing an award, the two years should be counted from 10.4.1992, making the proceedings lapsed by 9.4.1994.

Section 11A and its Explanation were invoked. The Explanation excludes the period of stay from the time fixed for passing the award.

The Explanation encompasses any action or proceeding pursuant to the declaration, including taking possession. The consequence of lapse operates only when all specified conditions conjoin.

Referring to Yusufbhai Noormohmed Nendoliya Vs. State of Gujarat, the Court clarified that the Explanation is broad and not limited to actions preceding the award.

Citing Sangappa Gurulingappa Sajjan Vs. State of Karnataka, the Court reaffirmed that even when dispossession alone is stayed, the period of stay is excluded from the time fixed for passing the award.

The position is settled that any stay, including dispossession, operates to exclude the period from the award's time limit.

Compliance with the second obligation does not depend on fulfilling the first obligation. Section 13(1) applies to suits for eviction based on any grounds enumerated in section 12(1)(a) to (p) and not just arrears of rent.
