Parents have a moral and statutory obligation to maintain their minor children. Maintenance includes provisions for food, clothing, residence, education, and medical attendance. The statutory duty arises under Section 125 of the Criminal Procedure Code and Sections 20 and 23 of the Hindu Adoptions and Maintenance Act, 1956 .

While the statutory duty to maintain children does not bar claims for damages due to medical negligence, they operate on different principles .

In a country with a rising population and a government-sponsored family planning program, the State and the doctor are responsible for damages if a sterilization operation fails due to negligence, creating an additional economic burden on the individual .

The contention of vicarious liability of the State for negligence is rejected based on established legal precedents.

Considering the respondent's financial situation and the burden imposed by the unwanted child, the State is held liable to pay damages for the negligence of the doctor .
