Temples Represent Culmination of Social and Religious Aspirations” – Kerala High Court Upholds Sacred Community Traditions in Ernakulam Siva Temple Festival Management

The Kerala High Court, in a landmark judgment concerning the management of the annual festival at Ernakulam Siva Temple, underscored the significant role of temples in society. Justices Anil K. Narendran and G. Girish, presiding over the case, WP(C) NO. 15798 OF 2023, emphasized the temples as “the culmination of social and religious aspirations of a society,” reflecting a deep-rooted belief in the cultural and spiritual fabric of the community.

The judgment, pronounced on December 14, 2023, addressed the petition filed by The Ernakulam Kshethra Kshema Samithi against the Cochin Devaswom Board and others. It revolved around the administrative and financial aspects of the festival for the year 2024.

A significant aspect of the judgment was the constitution of an Ad-Hoc Committee for the festival’s smooth conduct. This committee includes members from both the Cochin Devaswom Board and the Ernakulam Kshethra Kshema Samithi. The Court observed the need for a balanced representation to ensure the festival’s successful management, reflecting the community’s aspirations and devotion.

In their detailed observation, the judges highlighted the Temple Advisory Committee’s crucial role in aiding the smooth functioning of temple activities. The Court noted, “The worship that takes place in the sanctum sanctorum and within the temple premises is important; so are the festivals and occasional processions that involve the direct participation of the entire community.” This statement underlines the integral role of temples in not only serving individual spiritual needs but also in fostering community solidarity and joy.

Financial transparency and management were key focal points of the judgment. The Court meticulously examined the Kshethra Kshema Samithi’s failure in submitting audited accounts for certain years and emphasized strict adherence to financial norms and auditing processes.

In a move to ensure transparency and efficiency, the Court appointed Sri.K.N.Balachandran, a retired District Judge, as an Observer to oversee the Ad-Hoc committee’s activities related to the festival.
