Allowing to continue the criminal proceedings…would amount to abuse of process of Court:  Rajasthan High Court Quashes Criminal Charges in Dowry Harassment Case

In a significant judgment, the Rajasthan High Court has quashed the criminal proceedings against the in-laws and sister-in-law of the complainant in a dowry harassment case, citing an abuse of the process of court.

Legal Context: The case revolved around allegations made by Sugna D/o Shri Gopal against her in-laws under Sections 498-A (husband or relative of husband of a woman subjecting her to cruelty) and 323 (punishment for voluntarily causing hurt) of the Indian Penal Code. The allegations came nine years post her marriage to Suresh Kumar Narania, which according to the court lacked specificity and were unsupported by credible evidence.

Facts and Issues: The petitions for quashing the charges were filed under Section 482 of the Code of Criminal Procedure, asserting that the charges were nonspecific, framed without concrete evidence, and merely based on familial relationships rather than direct involvement in the alleged dowry harassment. The petitions emphasized the separation of the living arrangements between the complainant and the petitioners, questioning the viability of the claims made by the complainant.

Court’s Assessment: Justice Sudesh Bansal critically evaluated each accusation and the evidence presented. He noted the over-delay in lodging the FIR, the non-specific nature of the allegations, and the familial discord postulated as cruelty and harassment which did not convincingly point to the involvement of the accused in-laws. The court remarked that the framing of charges was based on general allegations which seemed aimed more at harassing the petitioners than seeking justice.

Justice Bansal cited precedents such as Geeta Mehrotra and Anr. Vs. State of Uttar Pradesh and Anr., where it was held that over implication in matrimonial disputes can lead to abuse of process of law. Further, it was observed that the proceedings appeared to be initiated more out of vengeance, emphasizing the need to scrutinize such complaints with care to prevent misuse of legal provisions.

Decision: The court ultimately quashed the charges against the petitioners, stating, “allowing to continue the criminal proceedings in the present criminal case for offences under Section 498-A and 323 IPC against petitioners would amount to abuse of process of Court.” However, the proceedings against Suresh Kumar Narania, the husband, are to continue independently.
