Supreme Court Hits Pause On UGC Equity Regulations-2026: ‘Vague, Capable Of Misuse’—2012 Norms To Continue

The Supreme Court on 29 January 2026 kept in abeyance the University Grants Commission’s “Promotion of Equity in Higher Education Institutions Regulations, 2026”, observing at the interim stage that the provisions are prima facie vague and capable of misuse.

A Bench led by CJI Surya Kant (with Justice Joymalya Bagchi) directed higher educational institutions to continue following the UGC Regulations, 2012 until further orders, effectively restoring the pre-2026 compliance position for universities/colleges while the challenge is heard.

During hearing, the Court flagged concerns around the drafting and internal consistency of the 2026 framework, including incongruence in specific clauses (reported as Sections 3(c) and 3(e)) and the broader apprehension that undefined/vague standards could invite arbitrary implementation.

Background: protests and public pushback

The 2026 regulations triggered protests and criticism from multiple quarters, with opponents alleging that the rules could enable complaints on loosely framed grounds and disturb campus functioning; the controversy escalated quickly after notification earlier this month, prompting urgent judicial scrutiny.

The Supreme Court issued notice to the Union Government and the UGC and listed/returned the matter for 19 March 2026, meaning the stay remains operative until the Court takes the next call after hearing the respondents.
