Allow To Compound in Non – Compoundable Offence - SC

In a recent order Apex Court , in Guhan Vs State , allowed to compound in case U/s 307 and 149 of IPC by using the inherent power under Article 142 of Constitution.

Accused was convicted for attempt to murder U/s 307 and 149 IPC and his conviction was upheld by Hon’ble High Court, but sentence reduced to 18 months. The sister of the injured-PW-2 has married the accused No. 3 (Guhan).  The accused persons as well as the injured are all residents of the same locality.  To bring peace and in order to live cordially, the applications to compound the offence have been filed .

Apex Court allowed to the application to compound the offence in the light of facts that sister of victim has got marriage with Accused Ghuman.
