Serious Inaccuracy in Investigation Identified: Rajasthan High Court Denies Bail in Dowry Death Case

The Rajasthan High Court has denied the bail application of Prabhu Ram in a dowry death case, highlighting serious concerns about the accuracy and conduct of the police investigation. The order, delivered by Justice Rajendra Prakash Soni, underscores the discrepancies in the investigative process and emphasizes the need for rigorous and candid investigative standards in cases of dowry death.

Prabhu Ram, the petitioner, was implicated in the death of his wife, Rekha @ Mamta, who allegedly died under suspicious circumstances at her in-laws’ residence. The case, registered under FIR No. 23/2024 at Jaswantpura Police Station, Jalore District, involves charges under Sections 498-A (cruelty by husband or relatives) and 304-B (dowry death) of the Indian Penal Code (IPC).

The court scrutinized the investigative process, noting significant inaccuracies. Justice Soni remarked that the assumption of Rekha’s fall from the staircase was not corroborated by any witness statements recorded under Section 161 of the Criminal Procedure Code (Cr.P.C.). The judge expressed concerns that this narrative seemed to be an imaginative construct of the Investigating Officer (I.O.) rather than based on factual evidence.

“It prima-facie, appears that Investigating Officer has brought this fact on file, beyond the record in order to weaken the case of complainant/prosecution and to facilitate the accused to get a basis for defense.”.

The court gave significant weight to the medical and post-mortem reports, which suggested that Rekha’s death was unnatural. The evidence pointed towards the injuries being inconsistent with a simple fall, reinforcing the prosecution’s claims of foul play.

Justice Soni highlighted the Investigating Officer’s shortcomings, stating that the I.O.’s speculative conclusions compromised the integrity of the investigation. The judge emphasized the need for meticulous and honest investigation in dowry death cases to ensure justice.

The bail application was evaluated based on the gravity of the charges and the prima-facie evidence against the petitioner. The court concluded that the allegations against Prabhu Ram were serious and well-supported by the material on record, thereby justifying the denial of bail.

“In view of the enormous prima facie material placed on record in respect of the applicant, the allegations leveled against the petitioner, I am of the considered view that looking to the nature and gravity of the accusation in the instant case, the role attributed to the petitioner, the petitioner is not found entitled to be released on bail.”.

Justice Soni criticized the investigative lapses, stating, “This Court has identified such a serious inaccuracy and shortcomings in the investigation and charge-sheet filed by the Investigating Officer concerned. Said inaccuracy and assumption of investigation might significantly affect the case of the prosecution.”.

The dismissal of the bail application underscores the judiciary’s commitment to addressing dowry deaths with the seriousness they warrant. The judgment not only denies bail to the accused but also calls for accountability and improvement in investigative standards. The order has been sent to the Director General of Police, Rajasthan, and the Superintendent of Police for further action, highlighting the judiciary’s role in ensuring justice and proper conduct of law enforcement agencies.
