In a significant judgment delivered on May 25, 2024, the Allahabad High Court, presided over by Hon'ble Justice Mohd. Faiz Alam Khan, ruled in favor of Gurmeet Kaur, awarding her the custody of her two-month-old daughter, Gurisha. The decision comes amidst serious allegations of dowry harassment against the child's father, Navpreet Singh. The court emphasized the welfare of the child as paramount, ordering the child's transfer to the mother within seven days.

The case, Habeas Corpus Writ Petition No. 107 of 2024, was filed by Gurmeet Kaur, seeking the release and custody of her daughter, Gurisha, who was forcibly taken by Navpreet Singh from her maternal home on April 13, 2024. Gurmeet Kaur alleged continuous harassment for dowry and physical abuse, supported by an FIR under Sections 498-A, 323, 504, 506, 354, 427 IPC, and Section 3/4 of the Dowry Prohibition Act. Previous attempts by Kaur to reclaim her daughter, including a complaint to the Child Welfare Committee, Pratapgarh, were unsuccessful.

Paramount Consideration of Child’s Welfare: The court reiterated that the welfare of the child is paramount in custody matters, surpassing the legal rights of the parents.

Mother’s Role in Early Childcare: Emphasizing the tender age of the child and the necessity of maternal care, the court concluded that the welfare of Gurisha would be best secured with her mother.

Visitation Rights for the Father: The judgment also ensures that Navpreet Singh is granted visitation rights, allowing him to meet his daughter twice a week.

Immediate Compliance Ordered: The court directed the Chief Judicial Magistrate and Superintendent of Police, Pratapgarh, to ensure the immediate transfer of custody.

Justice Khan meticulously analyzed the circumstances under which the child was taken from her mother. Despite Navpreet Singh's claims of lawful custody and allegations against Kaur, the court found no substantial evidence to deem Kaur unsuitable as a caregiver. The court highlighted the physical and emotional needs of a newborn, which are predominantly fulfilled by the mother, especially when the child is breastfed.

The court referred to several precedents, including Kannu Sanyal v. District Magistrate, Darjeeling, and Capt. Dushyant Somal v. Smt. Shushma Somal, emphasizing the necessity to prioritize the child's welfare over parental disputes. The legal framework within which the judgment was made underscored that custody issues, especially involving infants, should be resolved with a humane approach, considering the child's overall well-being.

Decision: The Allahabad High Court’s decision marks a crucial step in safeguarding the rights and welfare of infants caught in custodial battles amidst familial disputes. The court's direction to ensure compliance within a week underscores the urgency and importance of the child's immediate welfare. Future legal actions may arise, but the current judgment places the child’s best interests at the forefront, providing her a secure and nurturing environment with her mother.

Date of Decision: May 25, 2024
