Kshettra Panchayat and Zila Panchayat Adhiniyam, 1961 mandates that the Collector alone has jurisdiction to act on a notice of no confidence motion – Delegation of such powers to an Inquiry Committee or District Panchayat Raj Officer is impermissible – Orders passed by the District Panchayat Raj Officer rejecting the notice of no confidence on the basis of an Inquiry Committee report held to be without jurisdiction [Paras 33, 37].

No Confidence Motion – Collector’s Role and Inquiry into Validity of Signatures – Collector is required to conduct a prima facie verification of the validity of signatures in the notice of no confidence by examining the records of the Kshettra Panchayat – Detailed evidentiary inquiry or delegation of such inquiry is beyond the statutory powers of the Collector – Actions of the Collector in relying on an Inquiry Committee report to reject the notice were held to be illegal and contrary to the statute [Paras 23–27, 36].

Improper Delegation of Powers – Under Section 15 of the Act, 1961, powers conferred on the Collector cannot be delegated to any authority other than the Additional Collector as per statutory provisions – Constitution of an Inquiry Committee by the Collector and reliance on its report violated the statutory mandate [Paras 26, 33].

Improper Impleadment – No Fatal Defect – Failure to implead the Block Pramukh by name does not render the writ petition invalid when the concerned party has entered an appearance and has been heard – Improper impleadment is a curable defect and not fatal to the proceedings [Para 22].
