Four police officers, including an IPS officer, were sentenced to four weeks in prison for contempt of court on Monday by the Telangana High Court.
The Bench of Justice G Radha Rani issued the order after determining that the defendants had willfully disregarded the Arnesh Kumar v. State of Bihar guidelines.
According to the court, the transgressors violated the Supreme Court's guidelines for issuing a notice of appearance under section 41A of the Criminal Procedure Code to the accused within two weeks of the case filing date.
The court also ordered the state government and police commissioner to initiate disciplinary action against those who violated the Arnesh Kumar guidelines.
In this case, the petitioner approached the High Court and argued that the police issued a Look Out Circular against them and also sought non-bailable warrants against them without providing notice under section 41A of the Criminal Procedure Code, which violates Supreme Court guidelines.
In addition, the petitioner claimed that in a case involving cruelty under the Dowry Prohibition Act, NBWs were fraudulently procured and she was humiliated.
In this context, the petitioner urged the court to punish the negligent police officers.
As a violation of Apex Court guidelines, issuing a LOC or NBW without notifying the petitioner is a violation of the court's initial ruling.
Therefore, the court sentenced the violators to four weeks in prison and a Rs 2,000 fine each.
However, the court suspended the sentence for six weeks to allow the violators time to file an appeal.
