Right to Know Salary Details of Husband in Matrimonial Dispute Upheld: Madras High Court Dismisses Challenge Against Information Disclosure

In a significant ruling on January 4th, 2024, the Madurai Bench of the Madras High Court upheld the decision of the State Information Commissioner that mandated the disclosure of a husband's salary details to his wife amid ongoing matrimonial proceedings. The ruling, delivered by the Honourable Mr. Justice G.R. Swaminathan, reaffirmed the right of a spouse to access pertinent financial information in the context of maintenance claims.

The case, W.P.(MD)No.15513 of 2020, revolved around the petitioner, identified as V.A. Anand, who contested the State Information Commissioner's directive to his employer to provide his salary details to the fourth respondent, his wife, A.V. Suganya. This directive was initially issued to assist the fourth respondent in her pursuit of maintenance.

Justice Swaminathan observed, “In the facts and circumstances of the case, the fourth respondent herein cannot be called as third party. When the matrimonial proceedings are pending between them, the fourth respondent does require certain basic details.” This statement underscores the court's position that within the framework of a matrimonial dispute, especially concerning maintenance, a wife is entitled to know her husband's financial status.

Drawing parallels with a precedent from the High Court of Madhya Pradesh in the case of Sunita Jain V. Pawan Kumar Jain and Others (W.A.Nos.168 and 170 of 2015), the court pointed out that similar rulings have affirmed this right in the past.
