The High Court of Karnataka, in a landmark judgment, emphasized the confidentiality in judicial inquiries and the responsibilities of media in reporting on allegations against judicial officers. The Court critically evaluated the conduct of a media house New Indian Express in reporting partial facts and the importance of preserving the integrity of the judicial process.
The case revolved around a retired District and Sessions Judge who sought the removal of a defamatory online news report, initiation and conclusion of a departmental inquiry, and damages against the respondents. The key issues included judicial inquiry into alleged misconduct, media reporting ethics, confidentiality breaches in the judicial inquiry, and compensation claims.
The Court highlighted, “A responsible Newspaper such as the New Indian Express ought to have ascertained complete facts,” stressing the ethical obligations of media in sensitive cases involving judicial officers. The Court criticized the partial reporting of the New Indian Express, leading to misinformation and reputational harm.
The Court observed that the petitioner was exonerated by the Full Court’s decision not to accept the inquiry report, underlining the judiciary's responsibility in conducting impartial and thorough inquiries.
The Court underscored, “an inquiry be conducted by the High Court as to how the inquiry Report dated 30.05.2013 became available to the Newspaper,” emphasizing the need to maintain confidentiality and protect the integrity of judicial processes.
Decision: The Court dismissed most of the petitioner's claims, including the request for compensation from the High Court. However, it directed the respondent media house to pay costs for irresponsible reporting. The Court ordered an inquiry into the leak of the confidential report, affirming the balance between judicial integrity, accountability, and media freedom.
