Failure to Disclose All Facts: Gujarat High Court Quashes Impugned Order in Trust Dispute

In a significant legal development, the Gujarat High Court, presided over by Honorable Mr. Justice Devan M. Desai, has quashed an impugned order in a trust dispute case, emphasizing the importance of full disclosure of relevant facts before the court. The judgment, delivered on December 18, 2023, sheds light on the intricacies of trust matters and highlights the need for transparency in legal proceedings.

The case, Balakdas Vaishnav v. Shirish Jamnadas Fudhanwala, revolved around the appointment of trustees for a religious trust governed by the Bombay Public Trusts Act, 1950. Notably, the trust lacked a written constitution, leading to a dispute over trusteeship. The appellants had been appointed as administrators in the absence of a formal constitution.

In its observation, the court underscored the significance of fully disclosing facts and stated, “It is apparent that if correct facts would have been disclosed before the learned Judge, the impugned order would not have been passed.” The court stressed the need for transparency in legal proceedings, particularly when dealing with matters of trust and trusteeship.

The judgment also raised questions about the role of the Charity Commissioner in the case. It directed the Charity Commissioner to decide scheme applications filed by various parties expeditiously within a three-month timeframe.
