In a landmark judgment, the Allahabad High Court, under the bench of Justice Siddharth, granted bail in a sensitive case involving the alleged abduction and sexual assault of a minor girl. The case, titled Salman v. State of U.P. and 3 Others, Criminal Misc. Bail Application No. 47221 of 2023, was decided on November 6, 2023, and has garnered significant attention due to its nuanced approach towards the consent of minors in romantic relationships, especially under the stringent POCSO Act.

Justice Siddharth, in his judgment, emphasized the importance of a "bio-social approach" in understanding cases involving adolescents and young adults. This approach considers both biological and social factors that influence the behavior and decisions of teenagers, particularly in the context of romantic relationships.

The Court’s decision was influenced by the circumstances of the case where the victim, a minor, appeared to have consented to the relationship with the accused. The Court stated, "It is crucial to accept the science and psychology of an adolescent and young adulthood at this juncture," acknowledging the complex interplay of factors that guide adolescent behavior.

The Court also referenced several precedents, including the landmark cases of S Varadarajan Vs. State of Madras and Atul Mishra vs. State of U.P. and 3 Others, to underline the need for judicial discretion in such cases. Furthermore, the Court laid down stringent conditions for the grant of bail, ensuring the presence of the accused during the trial and preventing any tampering with evidence or witnesses.

This judgment has been seen as a significant step in acknowledging the complexities involved in cases under the POCSO Act, particularly those involving adolescent consent. It highlights the judiciary's evolving perspective on dealing with cases involving young individuals and the need for a more nuanced understanding of their psychological and social dynamics.

The Allahabad High Court's decision is expected to set a precedent for future cases involving similar circumstances, where the context of adolescent relationships and consent must be carefully considered within the legal framework.
