In a significant verdict, the Supreme Court today directed the Central Bureau of Investigation (CBI) to take over the investigation into the mysterious death of a 25-year-old girl from Manipur, initially registered as a suicide and later treated as a homicide. This case, Awungshi Chirmayi and Anr. v. Government of NCT of Delhi and Ors., brought to the fore the challenges in securing a fair investigation in cases involving victims from remote areas.

Legal Point of Judgment: The Supreme Court's intervention emphasizes the fundamental right to a fair investigation in criminal matters, irrespective of the victim's geographical and social background. It also showcases the Court's jurisdiction and authority in directing re-investigations in criminal cases, particularly when initial probes yield inconclusive or unsatisfactory outcomes.

Facts and Issues: The deceased, a young woman from Manipur, was found dead in her rented accommodation in Delhi under mysterious circumstances. The initial investigation, marked by inconsistencies and an inconclusive post-mortem report, failed to ascertain the cause of death, leading to widespread suspicion and demands for a thorough investigation.

Court Assessment: The Supreme Court critically assessed the sequence of events and the inefficacy of the police investigation. Citing significant precedents, including State of West Bengal and Others vs Committee for Protection of Democratic Rights, West Bengal and others, the Court reiterated its powers to order further investigation, especially in cases with significant implications or unsatisfactory initial probes. It observed, "Criminal investigation must be both fair and effective." The Court underscored the importance of instilling confidence in the investigative process and delivering justice to the family residing in a distant state.

Decision: Overturning the Delhi High Court's earlier judgment, the Supreme Court ordered the transfer of the investigation to the CBI, highlighting the need for an unbiased probe and the apprehension of the true culprits. The Court directed the Special Investigation Team (SIT) previously handling the case to transfer all relevant documents to the CBI, which is mandated to expedite the investigation and submit a report or charge sheet to the competent court.

Date of Decision: March 22, 2024.
