Roping in Entire Family in Criminal Litigation Without Basis Constitutes Mental Cruelty: High Court of Madhya Pradesh Grants Divorce on Grounds of Cruelty and Desertion

The High Court of Madhya Pradesh, in a landmark decision, has granted a divorce decree in favor of the husband, Karandeep Singh Chawla, citing the wife's act of implicating the entire family in false criminal cases as 'mental cruelty'.

The marriage, solemnized on 09.02.2014, fell apart within five months, leading to several criminal and civil litigations initiated by the wife, Gurshish Kaur, against her husband and his family. The husband sought divorce on grounds of cruelty and desertion under the Hindu Marriage Act, 1955.

On Desertion: The Court observed that the wife's departure from the matrimonial home was without reasonable cause and against the husband's wishes, fulfilling the legal definition of desertion.

On Cruelty: The Court noted the reckless, defamatory accusations made by the wife against the husband and his family. False criminal cases and the non-compliance of court orders regarding the husband's visitation rights to their child were considered serious instances of mental cruelty.

Impact on Marriage: The judgment highlighted that the actions of the wife caused irreparable damage to the marital relationship, leading to an irretrievable breakdown of the marriage.

Decision: The Court dissolved the marriage on grounds of cruelty and desertion, setting aside the judgment of the Family Court, Jabalpur.
