In a significant ruling, the Kerala High Court today emphasized the necessity of maintaining the status quo on disputed properties during the pendency of a partition suit, thereby protecting the interests of all parties involved until a final decision is reached.

The court deliberated on the crucial aspect of interim injunctions in property disputes, highlighting the importance of such measures to prevent the possible alienation or degradation of properties during ongoing legal proceedings. This is aimed at ensuring that the value and integrity of the properties are not compromised before the final adjudication.

The appeal was filed by the heirs of Late Augustine J. Kattady against the orders of the Principal Subordinate Judge of Palakkad, which they claimed inadequately addressed the risk of alienation and damage to the family properties and a fixed deposit. The properties were initially purchased by Late K.J. Joseph and registered under various family members’ names, raising disputes over rightful ownership and claims after his and his son Augustine’s deaths.

Property Rights and Interim Orders: Justice G. Girish reviewed the local investigation reports, which indicated a lack of clear demarcation among the properties, substantiating the appellants’ fears of potential mismanagement or alienation. The court stressed the importance of maintaining the current conditions of the properties to prevent any actions that could prejudice the parties’ rights before the matter is fully resolved.

Handling of Fixed Deposit: The fixed deposit issue was also scrutinized, with the court ruling to restrict any withdrawal from the deposit until the legal entitlements of the parties were clearly determined, ensuring that no financial maneuvers could affect the equitable distribution intended by the partition suit.

Decision of the Court: Upholding the appeals, the High Court expanded the temporary injunctions to cover all activities potentially impacting the properties and the fixed deposit. It issued orders against any form of destruction, waste, and creation of documents related to the properties, as well as against releasing the fixed deposit funds, until the final settlement of the partition suit.
