High Court Grants Compensation to Real Brothers in Motor Accident Claims Case

In a significant legal development, the Punjab and Haryana High Court, presided over by HON’BLE MRS. JUSTICE ALKA SARIN, has ruled in favor of real brothers seeking compensation in a motor accident claims case. The judgment, delivered on 12th January 2024, sets a noteworthy precedent in the realm of compensation for accident victims.

The court's observations highlight the key legal points of the judgment. Justice ALKA SARIN stated, "Though the claimant-appellants cannot be held to be dependent on the deceased, they would be entitled to compensation under the conventional heads i.e., loss of estate and funeral expenses, as well as under the head of loss of filial consortium." This statement underscores the court's emphasis on recognizing the rights of real brothers in compensation claims, even when traditional dependency cannot be established.

The judgment also addresses the issue of interest on compensation, with the court ruling that the compensation awarded should attract interest at the rate of 7.5% per annum from the date of filing the claim petition until the entire amount is realized.

This decision modifies the award passed by the Motor Accident Claims Tribunal, Jind, and grants the claimant-appellants a total compensation of Rs. 1,32,000. It brings relief to the real brothers of the deceased accident victim and ensures that they receive the compensation they are entitled to.
