Compensation Cannot Compensate for the Loss, But Should Mitigate Financial Difficulties – Punjab and Haryana HC Dismisses Appeal in Motor Accident Claim

In a significant ruling, the High Court of Punjab and Haryana has dismissed an appeal by The New India Assurance Company Limited challenging the compensation awarded by the Motor Accident Claims Tribunal, Karnal, for a fatal road accident. The decision, pronounced by Hon’ble Mrs. Justice Alka Sarin, emphasized the role of compensation in mitigating financial difficulties, especially for the young widow and minor children of the deceased.

 

The legal point at issue was the appropriate basis for income assessment for compensation in cases of fatal road accidents. The Tribunal had calculated the deceased’s income based on Deputy Commissioner rates, which the appellant insurance company contested, arguing for the application of minimum wages instead.

On 23.06.2020, Ajay and Parveen were involved in a road accident caused by a tractor. Ajay succumbed to his injuries, leading to a claim petition by his legal representatives. The Insurance Company, in its appeal, contended contributory negligence and questioned the income assessment method used by the Tribunal.

Contributory Negligence: The court rejected this argument, noting that it was not raised before the Tribunal and lacked supporting evidence.

Income Assessment: The court upheld the Tribunal’s method of using Deputy Commissioner rates for income assessment. It referred to various precedents, including the National Insurance Company Limited vs. Meena Devi & Ors., where the Supreme Court dismissed a similar challenge.

Role of Compensation: Justice Sarin highlighted that while compensation cannot make up for the loss of a loved one, it should sufficiently address the financial hardships faced by the dependents. The Court found the Tribunal’s assessment just and reasonable, considering the young age of the widow and the minor children.

Decision: The High Court dismissed the appeal, endorsing the Tribunal’s award of Rs. 35,49,112 as compensation, and recognized the non-mandatory nature of applying minimum wage rates strictly in such assessments.
