In a significant judgment, the High Court of Madras, presided over by the Honourable Justice N.Anand Venkatesh, reinforced the right to conduct religious functions such as Bhajans and Annadhanams, emphasizing the need for responsible conduct and peace in society.
The court was hearing a writ petition (Writ Petition No.1430 of 2024) filed by L.Ganapathy against the initial rejection of permission by the Assistant Commissioner of Police, Avadi Division, for an event scheduled on January 22, 2024, at KKR Kalyana Mandapam, Pattabiram. The petition challenged the order under Article 226 of the Constitution of India.
During the proceedings, the Honourable Justice Venkatesh sought clarification on the government and police policies regarding granting permissions for such religious functions. The court was informed that private events like Bhajans or Annadhanams in private enclosures do not require police permission. However, events with potential public spill-over or those in temples controlled by the HR & CE Department would need to be informed to authorities for necessary measures.
In his landmark decision, Justice Venkatesh observed, "Bhakti towards God is only for peace and happiness and not to disturb the equilibrium prevailing in the society." This statement underlines the judgment's ethos, ensuring that religious functions are conducted without disturbing public order or spreading misinformation.
The court disposed of the writ petition with specific directions, clarifying that such religious activities are not prohibited or restricted per se, provided they are carried out responsibly and without causing law and order problems.
