"Court Upholds Restart of Lambardar Appointment Process Citing COVID-19 Impacts; 'Decision meets the ends of justice' - Punjab and Haryana High Court"

In a recent decision by the Punjab and Haryana High Court, the decision to restart the Lambardar appointment process in Village Kharar, Punjab, has been upheld. The case, Sukhjinderpal Singh vs. The Financial Commissioner (Appeals), Punjab and ors., had come before Justice Rajesh Bhardwaj on 28th July 2023.

The petitioner, Sukhjinderpal Singh, had challenged several orders related to the appointment procedure, primarily opposing the acceptance of Amanjeet Singh's application, which he alleged was submitted fraudulently after the stipulated deadline.

The Court, in its judgement, stated, "The procedure which was initiated for the appointment of Lambardar was during the Pandemic. There is no gainsaying that due to the prevailing situation, at that time, all the willing persons could not have come forward for filing their applications in pursuance to mustri munadi."

Highlighting the limited number of applicants for the position due to the COVID-19 pandemic, the High Court observed that it was reasonable to restart the process to ensure a fair opportunity for all potential candidates.

Justice Bhardwaj concluded, "In the facts and circumstances, the decision meets the ends of justice," thereby dismissing the petitioner's contentions.
