Supreme Court Quashes FIR  in Gang Rape Case Against Appellant for Lack of Specific Allegations

In a recent verdict On 08 August 2023, the Supreme Court of India quashed the FIR registered against the appellant in a land dispute case due to the absence of specific allegations against the accused. The bench, comprising of Justice J.B. Pardiwala, pronounced the judgment on August 08, 2023.

The case, titled *Haji Iqbal @ Bala v. State of U.P. & Ors.*, involved allegations of rape, criminal intimidation, and a land dispute. The appellant was accused No. 2 in the FIR and had appealed to quash the FIR after it was rejected by the High Court. The central question before the Supreme Court was whether the allegations in the FIR were sufficient to proceed with the trial against the appellant.

Justice Pardiwala, while delivering the judgment, emphasized that the FIR contained no specific allegations against the appellant and that his name appeared in the FIR without any particular role or active participation attributed to him. The Court observed that mere naming of the appellant in the FIR was not enough to sustain criminal proceedings.

The Court further noted the delay of almost four years in lodging the FIR after the alleged incident took place. This delay, according to the Court, raised concerns about the credibility of the allegations and the possibility of personal grudge or vengeance. The bench stressed that while allegations of rape are serious and should not be taken lightly, false allegations can also cause distress and humiliation to the accused.

The judgment highlighted the Court's duty to closely examine the FIR, taking into account the attending circumstances and materials collected during the investigation. The Court clarified that its observations were limited to the specific case and would not impact other pending proceedings.

Supreme Court allowed the appeal, quashing the criminal proceedings against the appellant based on the FIR. The verdict underscored the importance of specific and credible allegations for sustaining criminal cases, ensuring fairness and justice in the legal process.
