Rajya Sabha Secretariat Not Governed by Section 80 CPC: Delhi High Court

In a significant ruling, the Delhi High Court has clarified that the Rajya Sabha Secretariat is not covered by Section 80 CPC (Code of Civil Procedure), highlighting a clear distinction between the "Government" and a "public officer."

- "The Rajya Sabha Secretariat, being the permanent administrative office of the Rajya Sabha, is a separate and distinct institution from the Government, which is the Executive wing of the State."

- "The word 'Government' appearing in Section 80 CPC does not include the Rajya Sabha Secretariat."

- "Section 80 CPC has no application to the suit filed by the appellant/plaintiff against the Rajya Sabha Secretariat, against which relief has been sought-for in the suit."

This ruling comes after a civil suit was filed against the "Rajya Sabha Secretariat Through its Secretary General," questioning the applicability of Section 80 CPC in the context of this suit.
