High Court of Punjab & Haryana Grants Bail in Intriguing Case of Fabricated Injury

In a recent ruling, the High Court of Punjab & Haryana granted bail to Pawan @ Khunta @ Praveen, implicated in a case involving fabricated injury and conspiracy. The case, initially registered under grave charges including Section 307 (Attempt to Murder) of the IPC, later saw a dramatic turn with the revelation of a fabricated firearm injury.

Justice Jasjit Singh Bedi, presiding over the matter, remarked on the complexity of the case, highlighting the evolving nature of the evidence and the charges against the accused. The judge's observation serves as a reminder of the judicial process's commitment to fairness and the principle of innocent until proven guilty.

The FIR, lodged at Police Station Hodal, District Palwal, Haryana, originally accused several individuals of a violent attack. However, subsequent investigations revealed a plot to falsely implicate certain individuals, leading to a reshuffling of charges and accused. The petitioner, Pawan @ Khunta @ Praveen, not initially named in the FIR, was later implicated based on co-accused disclosure statements.

Justice Bedi, acknowledging the prolonged custody of the petitioner since May 24, 2022, and the slow pace of the trial with only one of the nineteen prosecution witnesses examined so far, granted bail. This decision was also influenced by the fact that several co-accused had already been granted bail. The court ordered the petitioner's release on bail, subject to furnishing bail and surety bonds to the satisfaction of the concerned CJM/Duty Magistrate.

The court imposed specific conditions for the grant of bail, including the petitioner's monthly appearance at the concerned police station and the creation of a Fixed Deposit Receipt of Rs. 1,00,000, which would be forfeited in case of non-compliance with court orders.

This case sets a significant precedent in dealing with cases where the nature of allegations and the accused's roles evolve over time. The court's balanced approach, considering both the seriousness of the charges and the rights of the accused, reflects the intricate nature of judicial decision-making in the criminal justice system.
