Detention During Trial Cannot Be Taken as Punitive Detention: High Court Grants Bail in Money Laundering Case

In a significant development, the Delhi High Court today granted bail to Avtar Singh Kochar, a key accused in a high-profile money laundering case involving hawala transactions. The case, linked to the notorious Sukesh Chandra Shekhar extortion racket, had garnered widespread attention due to its complexity and the involvement of high-value transactions across international borders.

Justice Dinesh Kumar Sharma, presiding over the case, made a crucial observation underscoring the essence of justice in bail considerations. “Detention during trial cannot be taken as punitive detention,” he stated, highlighting the fundamental legal principles governing bail decisions. This observation formed the crux of the court’s decision to grant bail to Kochar, who has been in custody for over two years.

The case presented by the Enforcement Directorate (ED) painted Kochar as a pivotal figure in a vast network that facilitated the transfer of extortion money. The ED's argument focused on Kochar’s alleged role in transferring large sums of money through hawala channels, both within India and to places like Dubai, underlining the severity of the offence and its implications on national economic security.

However, the court, while acknowledging the seriousness of the allegations, emphasized the importance of a balanced approach. It considered the petitioner’s age, health condition, and the extended period of his incarceration as critical factors in its decision. The court also noted that the trial is still in its initial stages and may take considerable time to conclude, which played a significant role in the decision to grant bail.

In granting bail, the court has laid down stringent conditions. Kochar is required to furnish a personal bail bond of Rs. 5,00,000 with two sureties of the like amount, appear before the court regularly, not leave the National Capital Region (NCR) without permission, and refrain from international travel without court authorization. Additionally, he is prohibited from making any inducement, threat, or promise to any person acquainted with the facts of the case.
