In a significant decision, the Punjab and Haryana High Court issued a directive to enforce the Standard Operating Procedure (SOP) aimed at ensuring the timely appearance of prosecution witnesses during trials. The court’s attention was drawn to concerns about delays in trials and the extended incarceration of undertrials due to alleged non-compliance with mandatory provisions.

The Bench emphasized the need for strict adherence to the SOP and called for action against officials who fail to appear as witnesses. The court’s order also outlined the circulation of circulars to enhance the administration of criminal justice, underscoring the importance of efficient trial proceedings.

The ruling further addressed a bail petition related to a Narcotic Drugs and Psychotropic Substances (NDPS) case. The petitioner alleged false implication and lack of compliance with NDPS Act provisions. Despite four dismissed bail petitions, the court noted the slow progress of the trial, with charges framed and the majority of prosecution witnesses already examined.

Citing the petitioner’s non-violent offense and the absence of evidence tampering concerns, the court granted bail with additional conditions, highlighting the petitioner’s right to liberty.

This ruling emphasizes the court’s commitment to upholding the rights of undertrials and ensuring the timely dispensation of justice. The decision sets a precedent for the strict enforcement of procedural guidelines and the accountability of officials responsible for witness appearance.
