In a landmark judgment, the Madras High Court, presided over by the Hon’ble Mr. Justice N. Anand Venkatesh, has upheld the rights of widows to participate in religious festivals and enter places of worship without discrimination. The court’s ruling came in response to Writ Petition No. 23119 of 2023, where the petitioner, Thangamani, the widow of Late Pongiyannan, sought police protection to attend the Periyakaruparayan temple festival.

The court categorically denounced the archaic beliefs and senseless practices that demean women based on widowhood. Justice N. Anand Venkatesh asserted, “All this can never continue in a civilized society, which is governed by the rule of law. A woman, by herself, has a status and identity, and that cannot in any way come down or be taken away depending upon her marital status.”

The judgment emphasized that every individual, irrespective of their marital status, has an inherent right to participate in religious festivals and worship God. The court reprimanded respondents 5 and 6, who attempted to stop Thangamani and her son Srinath from entering the temple. The court directed the police to take immediate action against any individual who tries to impede the petitioner’s participation in the temple festival.

This landmark judgment sends a strong message against discriminatory practices and upholds the principles of equality and inclusivity in religious spaces. It sets a precedent for challenging outdated beliefs that hinder the rights and dignity of women in society.
