Sexual Assault on Minor Children is One of the Most Heinous Crimes”: High Court Upholds Conviction Under POCSO Act
In a significant ruling, the High Court of Judicature at Madras upheld the conviction of a painter, Ramakrishna alias Ramki, for sexually assaulting a 4½-year-old girl. The accused was sentenced to 7 years imprisonment and fined Rs. 5,000/- under Section 6 @ 10 of the POCSO Act, 2012.
Justice R. Hemalatha, in her judgment dated 04.08.2023, emphasized the gravity of the crime, stating, “sexual assault on minor children is one of the most heinous crimes which need very stringent punishment to curb the menace.”
The incident occurred on 19.04.2018, when the accused sexually assaulted the young victim. The appeal was filed contending non-examination of vital witnesses and contradictions in statements. However, the court found the evidence of the victim convincing and criticized the defense counsel for posing inappropriate questions to the young victim.
The court also expressed deep concern over the safety of young girls in society, observing, “In a developing country riddled with taboos and biases, we have seen women emerging out of the shell of ignorance and illiteracy. But, such incidents only make us feel that the future of young girls is unsafe.”
Justice Hemalatha further noted that “Sexual abuse, drugs, and alcohol are the three deep malaises that ruin a society and never allow development of the country.” She called for strict laws and effective implementation to eradicate sexual assault, ensuring a safe and secure society.
The judgment concluded with the dismissal of the criminal appeal, confirming the conviction and sentence passed by the Sessions Judge, Special Court for Exclusive trial of cases under the POCSO Act, Chennai.
This ruling serves as a stern reminder of the judiciary’s commitment to protecting the rights and safety of children, and its intolerance towards crimes against minors.
