Supreme Court Disposes of Appeal For Quashing of FIR After Investigation Developments

New Delhi, August 08, 2023 – In a recent development, the Supreme Court of India disposed of a criminal appeal based on subsequent investigation reports. The appeal arose from an order of the High Court of Judicature at Allahabad, wherein the petitioner had sought to quash an FIR registered under the Uttar Pradesh Gangsters and Anti-Social Activities (Prevention) Act, 1986.

The appellant, Mohmood Ali, had challenged the High Court’s decision to reject his plea to quash the FIR. However, a significant turn of events occurred as subsequent to the High Court’s ruling, the investigation officer filed a final report stating that no case was made out against Ali. This final report was subsequently accepted by the Additional Sessions Judge.

“Thus, it appears that after the High Court rejected the Criminal Miscellaneous Writ Petition, the final report was filed by the investigation officer stating that no case was made out to proceed against the appellant for the alleged offences. The said final report having been accepted by the Additional Sessions Judge… nothing more requires to be adjudicated upon in the present matter.”

The bench comprising Justices B.R. Gavai and J.B. Pardiwala observed that the developments in the investigation and the acceptance of the final report render the present matter unnecessary for further adjudication. As a result, the appeal was disposed of.

The Supreme Court clarified that the observations made in this judgment pertain solely to the concerned FIR and its proceedings, with no impact on pending criminal cases or other legal proceedings.

This case underscores the importance of diligent investigation and the potential impact it can have on legal proceedings. The Court’s recognition of subsequent developments led to a swift resolution of the matter, highlighting the judicial system’s responsiveness to evolving circumstances.
