Delhi High Court Directs Training for Newly Appointed Public Prosecutors and Addresses Pay Scale Revision
Delhi High Court, in a crucial judgment, has emphasized the vital role that public prosecutors play in the criminal justice system and highlighted the urgent need for their training. The case was heard by Hon’ble Chief Justice Satish Chandra Sharma and Hon’ble Mr. Justice Sanjeev Narula.
Revision of Pay Scales Under Consideration
The Union of India, represented by the learned ASG Mr. Chetan Sharma, informed the court that the revision of pay scales for Assistant Public Prosecutors is under active consideration by the Ministry of Home Affairs. The government has sought information from the Chief Secretary, GNCTD regarding the financial implications of such a revision (Para 1-3).
Lack of Training a Concern
The court expressed concern over the fact that 60 public prosecutors have been appointed recently without undergoing any formal training. The court stressed the importance of training in equipping prosecutors to discharge their responsibilities effectively (Para 4-6).
Unique Role of Public Prosecutors
The court detailed the unique and impartial role that public prosecutors play in the justice system. Unlike counsels for complainants or other parties, a Public Prosecutor’s role is to facilitate the administration of justice while adhering to the framework of law. The court emphasized that it’s imperative for newly appointed prosecutors to be adequately trained to carry out these responsibilities (Para 5).
Future Directions
The court directed the Government of the National Capital Territory of Delhi (GNCTD) to coordinate with the Delhi Judicial Academy to organize training for the newly recruited public prosecutors. The GNCTD is also required to file a status report detailing the implementation of these training programs and the current vacancies among public prosecutors. The next hearing is set for November 1, 2023 (Para 6-7).
