Supreme Court Overturns Murder Conviction Citing Unreliable Confession and Evidence Mismatch

In a significant judgment, the Supreme Court of India overturned the conviction of Prabhatbhai Aatabhai Dabhi, previously found guilty under Section 302 of the Indian Penal Code (IPC) for murder. Justices Abhay S. Oka and Pankaj Mithal presided over the case, delivering a verdict that highlighted critical flaws in the prosecution’s case.

The judgment, dated November 8, 2023, in the matter of Criminal Appeal No.1926 of 2011, emphasized the unreliability of the evidence presented by the prosecution. The Court observed, “Normally, an accused would not make a confessional statement before the real brothers of the deceased.” This observation cast doubt on the prosecution’s reliance on an extra-judicial confession purportedly made by the appellant to the deceased’s brother and an acquaintance.

Further undermining the prosecution’s case, the judgment pointed out inconsistencies regarding the murder weapon. While the prosecution claimed the appellant used a stick, evidence suggested the involvement of an axe, a disparity that the Court found significant. “The stick was not recovered,” the Court noted, questioning the narrative presented by the prosecution.

A pivotal point in the appellant’s acquittal was the discrepancy in blood groups found on his clothing. Contrary to the prosecution’s assertion that the blood belonged to the deceased, forensic analysis revealed a different blood group, leading the Court to state, “This militates against the case of the prosecution that the blood stains on the clothes of the appellant were of the blood of the deceased.”

The Supreme Court’s decision to acquit Mr. Dabhi underscores the principles of criminal jurisprudence, particularly the importance of proving guilt beyond a reasonable doubt. The appellant, who had already served over 11 years in prison and was released on bail in 2011, was finally acquitted of all charges. This ruling not only brings closure to a long-drawn legal battle but also serves as a reminder of the judiciary’s role in safeguarding the rights of the accused against wrongful conviction.
