Supreme Court Facilitates Amicable Resolution in Matrimonial Dispute: Upholds Dignity of Mutual Consent”
In a significant ruling today, the Supreme Court of India, led by Justices B.V. Nagarathna and Ujjal Bhuyan, showcased the judiciary’s proactive role in facilitating an amicable resolution in matrimonial disputes. The court successfully oversaw a mutual consent divorce settlement, upholding the dignity and mutual respect of the parties involved.
The case, involving the transfer petition (C) No. 594/2022 and I.A. No. 234137 of 2023, was filed under Section 25 of the Code of Civil Procedure, 1908. Petitioner Vrushali sought the transfer of a matrimonial case from Karnataka to Maharashtra, eventually leading to a mutual consent divorce settlement.
The court observed, “In the circumstances, the matter between the parties may be concluded by accepting the Settlement Agreement and granting the decree by divorce by mutual consent.” This statement highlights the court’s approach towards respecting the parties’ decision to amicably resolve their differences.
The settlement agreement detailed the dissolution of the marriage, financial settlements, and custody arrangements. Notably, it included a financial settlement of Rs. 7,50,000 from the petitioner to the respondent and specified property rights.
This ruling is a testament to the Supreme Court’s commitment to upholding the principles of justice, dignity, and mutual respect in sensitive cases like matrimonial disputes. By facilitating a settlement, the court has shown a preference for amicable resolutions over prolonged litigation.
