In a recent order, the High Court of Delhi has granted interim bail to a father, Mr. Karim, allowing him to meet his newborn child. The court’s decision comes in response to a bail application (Bail Appln. No. 1949/2023) filed by Mr. Karim under Section 439 of the Criminal Procedure Code.

The petitioner’s counsel argued that Mr. Karim’s wife recently gave birth to a baby boy and is currently unable to properly care for the child due to her weakened state. Emphasizing the importance of father-child bonding, the counsel requested the court to grant interim bail to Mr. Karim, enabling him to support his wife and newborn. It was assured that Mr. Karim would surrender himself at the conclusion of the 45-day bail period and would not seek any further extension.

The State, represented by the Additional Public Prosecutor, acknowledged the verified fact of the child’s birth and expressed no objection to providing relief to Mr. Karim.

Considering the circumstances and the petitioner’s newfound role as a father, Hon’ble Mr. Justice Rajnish Bhatnagar granted interim bail for a period of 45 days. The court imposed certain conditions, including the submission of a personal bond, restriction on leaving the jurisdiction of the State of NCT of Delhi without prior permission, providing contact details to the authorities, and sharing daily location updates via a mobile application.

This ruling serves as a precedent recognizing the significance of parental involvement in a child’s early life, ensuring the welfare of both the child and the parents. The court’s decision reflects a balance between the interests of justice and the petitioner’s familial responsibilities.

Mr. Karim’s counsel expressed satisfaction with the court’s decision, acknowledging the court’s sensitivity to the needs of families and their new additions. The ruling will undoubtedly provide Mr. Karim an opportunity to cherish the joys of fatherhood while responsibly addressing his legal obligations.
