Interim Bail Chandra Babbu Naidu on Medical Grounds: Preservation of Human Life is Paramount: Andhra Pradesh High Court
In a significant ruling, the Andhra Pradesh High Court, presided over by THE HON’BLE SRI JUSTICE T. MALLIKARJUNA RAO, has granted interim bail to a 73-year-old petitioner, who has been in judicial custody since September 10, 2023. The judgment, delivered on October 31, 2023, underscores the paramount importance of preserving human life, irrespective of the gravity of the alleged offense.
The petitioner, facing charges under various sections of the Indian Penal Code and the Prevention of Corruption Act, sought interim bail for medical examinations and treatment due to deteriorating health conditions. The Court, in its observation, emphasized the humanitarian aspect of the case, stating, “Preservation of human life is of paramount importance. Every individual has the inherent right to receive comprehensive and effective medical care.”
The medical reports presented in the case highlighted the petitioner’s fragile health condition, including Diabetes Mellitus and Hypertrophic Obstructive Cardiomyopathy. These reports recommended a range of tests and imminent cataract surgery for the petitioner’s right eye, emphasizing the inadequacy of medical supervision and facilities in jail.
While the State argued against the grant of interim bail, the Court recognized the petitioner’s significant societal standing and noted that “a patient in need of medical attention should be granted immediate, effective, and comprehensive treatment.” The Court firmly upheld the belief that individuals with serious health issues should have access to adequate medical treatment, even during the investigative phase.
In its judgment, the Court granted interim bail to the petitioner for four weeks, subject to certain conditions, including furnishing a bail bond and undergoing necessary medical examinations and treatment at a hospital of his choice. The Court stressed the importance of immediate medical attention, especially regarding the required cataract surgery.
