Refuses To Interfere With Lab Assistant Exam Schedule-Court Can’t Dictate Exam Dates: RJ HC
The bench of vacation of the Rajasthan High Court determined that the High Court Can’t Dictate Exam Dates and time of a particular examination.
In essence, the petitioners argued that the date of the examination for the recruitment to the post of Lab Assistant, which will be held on 28.06.2002 and 29.06.2022, conflicts with the dates of other examinations. In addition, the petition requested that candidates be given sufficient time to prepare for the examination because, according to the petitioner, the syllabus for the Lab Assistant examination has been revised and a lengthy syllabus containing numerous new topics has been added in place of the previously brief syllabus.
The court noted that all recruitment examinations and graduation examinations are not administered to a single individual or a specific group. These are the examinations for which the relevant department prepares a schedule in advance and which are administered after months of preparation, the court added.
Justice Rekha Borana, in ruling on the petition, remarked:
“This court does not believe that the allotted time is insufficient for any student to prepare for the exam. Moreover, said revised syllabus was challenged in the present writ petition, which was filed on 14.06.2022, a week before the scheduled examination date. Therefore, the present writ petition cannot be considered valid on this basis at this late date.”
Regarding the issue of conducting other examinations on the same date and clashing examination dates, the court opined that such interference cannot be made with the respective departments’ and authorities’ examination timetables and schedules.
The court noted that the petitioners may submit a formal statement to the relevant authorities detailing their grievances. The court added that the relevant authorities may consider the matter in light of the students’ best interests.
