High Court Rejects Bail in NDPS Case: “No Merit in the Petition, “Himachal Pradesh High Court
In a significant ruling, the Himachal Pradesh High Court, presided over by Justice Vivek Singh Thakur, dismissed a bail application in a high-profile narcotics case, emphasizing the seriousness of the allegations under the Narcotic Drugs and Psychotropic Substances Act, 1985 (NDPS Act). The case involved petitioner Rakesh Kumar, currently lodged at Model Central Jail Kanda, against the State of Himachal Pradesh.
In the judgment for case number Cr.M.P. (M) No. 1636 of 2023, Justice Thakur observed, “I do not find any merit in the petition,” leading to the dismissal of the bail plea. The petitioner was implicated in a case concerning the recovery of a substantial amount of charas.
The Court meticulously examined the circumstances surrounding the petitioner’s involvement. The petitioner’s connection to the crime was inferred from financial transactions and Call Detail Records linking him to the co-accused, Kushwind, who was caught with 6.528 kilograms of charas.
The petitioner’s counsel raised several grounds for bail, including alleged procedural breaches in collecting evidence and violations of the petitioner’s right to privacy. However, the court noted that these aspects are to be evaluated during the trial and not at the bail stage.
Justice Thakur pointed out, “With respect to delay, it has been contended by learned Additional Advocate General that there is no inordinate delay in completion of trial because trial is likely to be completed within reasonable period of three years.”
The court’s decision underscores the rigorous approach adopted by the judiciary in matters involving drug trafficking, especially considering the societal impact of such crimes. The dismissal of the bail application serves as a reminder of the seriousness with which the courts view offences under the NDPS Act.
