“High Court Quashes FIR Alleging Sexual Harassment, Citing ‘Abuse of Process of Law’”
In a significant legal development, the Bombay High Court recently quashed a First Information Report (FIR) filed against Mr. Vijay Choudhary, Vice President of Human Resources at Max New York Life Insurance. The judgment, pronounced by Justices A. S. Gadkari and Shivkumar Dige on August 11th, 2023, emphasized the importance of upholding justice and safeguarding the legal process.
The FIR, lodged by Mrs. Hetal Desai, an employee at the company, alleged instances of sexual harassment and misconduct. However, the High Court found several irregularities and inconsistencies in the complaint, leading to the conclusion that the FIR was filed with a “mala fide intention” and amounted to an “abuse of process of law.”
Justice A. S. Gadkari, in the judgment, remarked, “The continuation of further investigation in the FIR lodged by the Respondent No.2 would be sheer abuse of process of law and needs to be quashed in the interest of justice.” The Court referred to established legal principles and relevant case law to arrive at this conclusion.
The Court’s decision highlighted the importance of prompt and accurate reporting in criminal cases. Referring to an observation from the Supreme Court’s judgment in the case of Thulia Kali v. The State of Tamil Nadu, the High Court noted, “Delay in lodging the first information report quite often results in embellishment which is a creature of afterthought. On account of delay, the report not only gets bereft of the advantage of spontaneity, danger creeps in of the introduction of coloured version, exaggerated account, or concocted story as a result of deliberation and consultation.”
Additionally, the judgment referred to the principles set out in the case of State of Haryana & Ors. V. Bhajan Lal & Ors., which outlines categories of cases where the court’s extraordinary powers can be exercised to prevent abuse of the legal process.
