Former CM Chandra Babu Naidu Got Anticipatory Bail Skill Development Scam Case – Lack of Direct Evidence: Andhra Pradesh
In a significant development, the Andhra Pradesh High Court, presided over by Justice T. Mallikarjuna Rao, granted regular bail to former Chief Minister Sri Nara Chandra Babu Naidu in the skill development scam case. The judgment, delivered on November 20, 2023, in Criminal Petition No. 7951 of 2023, has caught widespread attention, underscoring crucial aspects of legal principles and individual rights.
The case, which involves allegations of corruption and financial irregularities in the implementation of a skill development project by the Andhra Pradesh State Skill Development Corporation (APSSDC), had led to the arrest of Naidu among others. The prosecution accused Naidu of conspiring in a scheme that resulted in significant financial losses to the state exchequer.
In his ruling, Justice Rao cited several reasons for granting bail, emphasizing the absence of direct evidence linking the petitioner to the alleged crimes. He observed, “Despite serious allegations of financial misconduct, the prosecution failed to present prima facie material directly implicating the petitioner.” This lack of direct evidence played a pivotal role in the court’s decision.
Another critical factor in the court’s decision was the petitioner’s health condition. Naidu, aged 73, suffers from multiple health issues, including diabetes, hypertension, and Hypertrophic Cardiomyopathy, necessitating regular medical care. The presence of Z+ security from the National Security Guard (NSG) also reduced the perceived flight risk, further tilting the scales in favor of granting bail.
The court also took into account the petitioner’s right to freedom of speech and political activity, especially in his capacity as the National President of the Telugu Desam Party (TDP). The judgment remarked on the importance of maintaining a balance between the liberty of the accused and the public interest. “The conditions initially imposed due to the interim nature of previous bail for medical reasons were relaxed, acknowledging the petitioner’s fundamental rights,” stated Justice Rao in his judgment.
Furthermore, the judgment highlighted the need for a fair trial and the ongoing investigation. While the petitioner alleged political motivation behind his arrest, the court refrained from conclusive comments on these allegations, instead emphasizing the importance of an impartial judicial process.
