Penal Code, 1860 – Ss. 302 r/w. 34 – To deny the benefit of the acquittal to accused merely on the ground of a technicality that he is not on appeal would be gross injustice. Evidence Law – Whether the prosecution has to prove or need not prove that the blood groups match – Held, the judicial conscience of the Court should be satisfied both about the recovery and about the origin of the human blood.
