In a groundbreaking judgment, the Delhi High Court  has set aside an arbitral award and accompanying judgment, underscoring the utmost importance of compliance with court orders and procedural fairness in arbitration proceedings.

The judgment, delivered by an undisclosed Bench, comes as a resounding affirmation of the judiciary’s commitment to upholding justice and procedural integrity. The case involved an appeal against an arbitral award and judgment under the Arbitration & Conciliation Act, 1996, and the Commercial Courts Act, 2015.

The Bench highlighted the significance of following court orders, stating, “Compliance with court orders is vital in maintaining the integrity of the judicial process.”

The case centered on issues related to the arbitration procedure, with the appellant contending wrongful dismissal of their application under Section 34 of the Arbitration & Conciliation Act, 1996. The Arbitrator’s disregard for the Supreme Court’s order, which directed the consideration of the appellant’s application for filing a defense and counter-claim, further complicated the matter.

In its observations, the Delhi High Court noted, “Failure to adhere to higher judicial authority’s orders can have serious consequences on the fairness of arbitration proceedings.”

The Bench expressed concern over the appellant being prevented from presenting their case due to non-compliance with the Supreme Court’s directive. The judgment emphasized the principle of judicial discipline and procedural fairness in arbitration proceedings.

“In the pursuit of justice, adherence to procedural fairness is paramount,” remarked the Bench.

Ultimately, the impugned award dated 08.05.2015 and the judgment dated 01.03.2021 were set aside, marking a significant victory for the appellant. The judgment serves as a reminder of the judiciary’s commitment to upholding the rule of law and ensuring that the judicial process is characterized by fairness and compliance with court orders.
