Delhi High Court Imposes Fine and One-Month Imprisonment To Wife in Contempt Case, Citing Violation of Settlement Agreement
In a recent development, the Delhi High Court, presided over by Hon’ble Justice Manmeet Pritam Singh Arora, has ruled in a contempt of court case involving a violation of a settlement agreement. The court found the respondent guilty of wilfully reneging from the agreement, citing dissatisfaction with the financial settlement and an attempt to secure a more lucrative deal.
The court’s judgment, rendered on August 9, 2023, sheds light on the respondent’s conduct and the implications of her actions. The court observed, “Respondent’s refusal to abide by the settlement agreement undermines faith in legal proceedings,” highlighting the importance of upholding the sanctity of agreements made in court.
Notably, the respondent’s admission during the proceedings that she did not intend to resume marital life with the petitioner played a crucial role in the court’s decision. The court determined that the marriage had indeed broken down and that the respondent’s pursuit of a higher financial settlement through legal proceedings was tantamount to an abuse of the legal process.
Drawing from past judgments, the court imposed a fine and sentenced the respondent to one month of simple imprisonment. However, the court provided an opportunity for the respondent to avoid imprisonment by complying with the settlement agreement’s terms and conditions, as well as issuing an unconditional apology within two weeks.
The judgment also touched upon the court’s role in preserving the credibility of its undertakings, stating, “If parties such as the Respondent are permitted to walk away from their undertaking, the faith reposed by litigants in the judicial system and the finality of orders of the Court will be eroded.”
Furthermore, an application for the stay of proceedings, filed by the petitioner, was disposed of as not applicable in other jurisdictions. The court clarified that while the directions given in a previous judgment applied in personam, they did not extend to staying proceedings in courts of other states.
