The Supreme Court of India issued an interim order in a high-stakes case involving a petitioner’s exclusion from the personality test of the Engineering Services Examination (ESE) conducted by the Union Public Service Commission (UPSC). The Court has directed the UPSC to “convey a date for the petitioner to appear for the personality test,” adding that “the results of the petitioner shall be kept in a sealed cover till the next date of hearing.”

Surendra Kumar Choubey, the petitioner, approached the apex court under Article 32 of the Constitution, challenging UPSC’s decision to exclude him from the personality test due to discrepancies in the submission of his Income and Asset Certificates for Economically Weaker Sections (EWS) reservation.

The petitioner’s counsel informed the Court that he had duly submitted an online Income and Asset Certificate before the application’s cutoff date. However, UPSC declined to include him in the personality test for the reason that the submitted certificates were “after the closing date of online application for ESE2023
