The High Court’s verdict, while emphasizing the critical role of eyewitness accounts, addressed three pivotal questions:

1. Place of Occurrence Established Beyond Doubt:

The judgment stated, “Considering the facts of this case… there remains no doubt as regards to the place of occurrence.” This observation underlined the significance of eyewitnesses who consistently testified about the location of the incident, corroborated by physical evidence found at the scene.

2. Manner of Occurrence Corroborated by Evidence:

The verdict continued, “The evidence led by the above-stated eyewitnesses, one of them is an injured witness, is consistent, clinching, tallying with each other and clearly implicating the accused persons.” This highlighted the importance of aligning eyewitness testimonies with medical evidence, thus effectively establishing the sequence of events.

3. Non-examination of Independent Witnesses Does Not Undermine Credibility:
