A pregnant woman was recently granted anticipatory bail by the Bombay High Court on charges of assisting her husband’s suicide.

The court was hearing a woman’s application for anticipatory bail filed on April 16 in connection with a criminal complaint filed against her in Pune on April 16.

According to the facts of the case, Rahul and the applicant had been married for eight months before Rahul’s body was discovered near railway tracks in Pune.

It was alleged that he left a suicide note in which he blamed his wife for his death and demanded that she be punished.

The judge noted in the initial report of suspicious activity (FIR) that the husband was dissatisfied with his wife’s constant phone use.

“This individual has yet to be identified. It could be a member of her family, such as her parents or siblings, or a third party. It is understood that the applicant was already 3.5 months pregnant at the time. There are phone numbers in the alleged dying declaration (written note) that the prosecution must investigate “The judge observed.

In his May 30 order, Justice Jadhav stated that the applicant was charged with a heinous crime that, if she is found guilty, could result in a sentence of ten years of solitary confinement.

“However, given that the applicant is 25 weeks pregnant and carrying a fetus, it is also the Court’s responsibility to ensure that she and the fetus are protected at this stage and that she is not subjected to duress or stress,” the judge said.

The Court added that, given her current medical condition, she may be required to visit the hospital frequently and will require proper care and rest.

In granting her pre-arrest bail, the judge stated, “Her presence can always be secured by the prosecution and the Investigating Officer, and if necessary, the Investigating Officer can also visit her in consideration of her medical condition.”

The applicant was represented by attorneys Vivek Rane and Vijay Latange, while the State was represented by additional public prosecutor M R Tidke.
